Joshua Entin is a seasoned attorney and native Floridian with more than 20 years of experience representing clients across a wide range of legal matters. A proud graduate of Pennsylvania State University, Josh went on to earn his Juris Doctor, magna cum laude, from St. Thomas University School of Law, where he distinguished himself as a Law Review editor and Chairman of the Committee on Academic Integrity.

Defense Verdict after Four Day Jury Trial in Equestrian Fraud Case

Tornatore v. Scardino, No.: 2024-10046-CICI (Fla. Cir. Ct. June 16, 2025) (Final Judgment):

After a four-day trial featuring allegations of fraud, civil theft, breach of fiduciary duty, and FDUTPA violations in a racehorse business, the jury deliberated for only thirty minutes before returning a full defense verdict, completely vindicating Josh’s client against $2.1 million in claimed damages.

Defense Victory in Trial and Appellate Courts in Bahamian Sexual Assault Case

Vernon v. Brookfield Hospitality Properties, LLC, No. 4D2024-0937 (Fla. 4th DCA Jan. 30, 2025):

The Fourth District Court of Appeal affirmed the trial court’s dismissal of the plaintiff’s negligence claim against Josh’s corporate client, holding that an alleged sexual assault at the Atlantis Resort in the Bahamas—and the absence of any connection to Florida—made dismissal on forum non conveniens grounds proper, and thus Josh’s client prevailed completely on appeal.

Class Action Leads to Accessibility Improvements Nationwide

Access now, Inc. v. RTM Operating Company, 02-cv-23374-Martinez (SD Fla. August 9, 2006):

As lead trial counsel in an Americans with Disabilities Act class action lawsuit against a national restaurant chain, Josh successfully secured nationwide class certification and a court-approved settlement, resulting in the remediation of 1,000+ restaurants across the United States and ensuring improved accessibility for individuals with disabilities.

Appeals Court Dismisses Claims Against Police Officer

Hadley v. Gutierrez, 526 F.3d 1324 (11th Cir. 2008):

As lead trial and appellate counsel for a police officer in a case involving claims of excessive use of force and unlawful arrest, Josh successfully secured an appellate court reversal of the trial court’s denial of qualified immunity for the officer.

Paralympian Wins Case Against National Gym Chain

Shawn Cheshire v. Fitness & Sports Clubs, LLC, 2021 WL 7627605 (SD Fla. August 18, 2021):

As lead trial counsel in an action brought under Title III of the Americans with Disabilities Act, Josh secured a permanent injunction on behalf of a world-renowned blind Paralympian after a lengthy arbitration. This victory against a national gym chain addressed several issues of first impression concerning a visually impaired athlete’s rights to access a place of public accommodation.

Semprevivo v. Georgetown University, 19-1400 (RJL) (Dis. Columbia June 7, 2019):

In the first lawsuit of its kind filed in the nation, Josh and his co-counsel successfully represented an expelled student against a prestigious university in connection with the 2019 “Varsity Blues” college admissions scandal.

Lawyer for Plaintiff in Landmark Case Involving Website Accessibility for the Visually Impaired

Gil v. Winn-Dixie Stores, Inc., 21 F.4th 775 (11th Cir. 2021):

In this landmark ADA case on website accessibility, Josh was lead counsel for plaintiff-appellee (a visually impaired customer). After the plaintiff prevailed at trial against a national grocery chain, a panel of the Eleventh Circuit initially held that websites are not “places of public accommodation” under Title III of the ADA, reversing the trial court’s judgment. That panel decision was later vacated and the appeal was dismissed. This case was notable for its impact on how businesses’ websites are treated under the ADA, and is often cited in website accessibility cases throughout the country.

Successful Representation of a Florida Law Firm in a Fair Housing Act Case Brought by the United States, Department of Justice

United States v. Advocate Law Groups of Florida, P.A., 413 F. Supp. 3d 1225 (M.D. Fla. 2019):

Josh served as defense counsel for a Florida law firm (and its principal) accused of Fair Housing Act violations for allegedly running a “predatory” mortgage foreclosure rescue scheme targeting Hispanic homeowners. Josh obtained a dismissal of the majority of claims with prejudice.

Successful Defense Against a Multi-Million Dollar Wrongful-Death Case

Hinkle v. Angels House, LLC, 331 So. 3d 184 (Fla. 4th DCA 2021):

In this wrongful-death negligence case arising from the death of a patient after she had been treated at a rehabilitation facility, Josh represented several defendants. Josh successfully obtained a dismissal of all claims against his clients with prejudice. On appeal, the Fourth District Court of Appeal issued an affirmation of the trial court’s dismissal of all claims against Josh’s clients

Appellate Victory for Prestigious Fort Lauderdale Restaurant Group

Murka Holdings, LLC v. Global Eatery Group, LLC, No. 4D21-684 (Fla. 4th DCA 2022):

Josh represented the appellees before the Fourth District Court of Appeal (a well known south Florida restaurant business and its owner) in this commercial dispute. The case on appeal stemmed from a trial court ruling in favor of Josh’s clients. The appellate court affirmed the trial court’s judgment, leaving the victory with Josh’s clients intact.

Appellate Reversal of District Court Interference with Private Settlement

Myers v. Mo & Co., 452 Fed. Appx. 856 (11th Cir. 2011):

Josh successfully represented a client before the Eleventh Circuit Court of Appeals in a case where the district court improperly interfered with a private settlement agreement resolving the underlying claims. The appellate court reversed the district court’s order and reinstated the settlement agreement Josh’s client had entered into.

Victory at the Trial Court and Appellate Court for a Company sued for Age Discrimination

Perrero v. Spectacor Management Group, 308 Fed. Appx. 327 (11th Cir. 2009):

In this matter, Josh secured summary judgment in favor of his client in a case alleging age discrimination under the Age Discrimination in Employment Act. Josh subsequently obtained an opinion from the Eleventh Circuit Court of Appeals, affirming the district court’s summary judgment.

Successful Enforcement of Restrictive Covenants in Employment Contract

Unlimited Closing, Inc. v. Sunco Title & Escrow Co., 219 SO.3d 967 (Fla. 4th DCA 2017):

Josh successfully represented a title company against a former employee and two business entities controlled by her for breach of a non-competition agreement. Josh then prevailed on the appeal, where the Fourth District Court of Appeal affirmed the trial court’s injunction, and expanded on the state of the law in Florida concerning the waiver of a bond in cases addressing injunctive relief.

Appellate Success Reversing a Denial of Qualified Immunity for a Supervising Police Officer in a First Amendment Protest Case

Keating, et al. v. City of Miami Beach, et al, 598 F.3d 753 (11th Cir. 2010):

Josh successfully obtained a reversal from the Eleventh Circuit Court of Appeals of the district court’s order denying qualified immunity for a police officer accused of violating plaintiffs’ First Amendment rights for failing to stop subordinate officers from using less-than-lethal weapons to disperse a crowd of demonstrators.

Victory for Prestigious Miami Beach Hotel Sued for Violating the Family Medical Leave Act

Andrey Nazarov v. Catalina Hotel, LLC, 14-cv-20420 (SD. Fla. Nov. 7, 2014):

Josh successfully obtained summary judgment for a Miami Beach Hotel in a case brought by a terminated employee alleging a violation of the Family Medical Leave Act.
